Terms and Conditions 

 

  1. Definitions

Store – the online store available at https://www.lecanonvarsovien.com, through which the Buyer may purchase Products, Goods and Services available in the Store.

Seller – Justyna de Bure, conducting business under the name Justyna de Bure Marketing i PR, ul. Żurawia 21, 05-503 Głosków, Poland, Tax Identification Number (NIP): 764-224-87-22; REGON: 147170691; tel. (+48) 501 450 249; e-mail: info@lecanonvarsovien.com

Personal Data Controller – the entity determining the purposes and means of processing personal data. The Seller is the Personal Data Controller of Buyers’ personal data.

Online Store Terms and Conditions – these terms and conditions governing the provision of services by electronic means and setting out the rules for using the Store and placing Orders for Products, Goods and Services available in the Store.

Privacy Policy – a document describing the purposes and methods of processing personal data, as well as the rights of data subjects.

Consumer – an adult natural person with full legal capacity who purchases from the Seller for purposes not directly related to their business or professional activity.

Buyer – a Consumer, Entrepreneur, or Entrepreneur with consumer rights.

Entrepreneur with Consumer Rights – a natural person conducting sole-trader business activity who purchases from the Seller for purposes not directly related to their professional activity, in accordance with their entry in the Central Register and Information on Business Activity (CEIDG).

Product – all digital content available in the Store.

Service – all event tickets

Electronic File – training materials, exercise books and micro-training aids (e.g. PDF, DOCX files) containing digital content intended for reading and available for download after payment has been received.

Account – a service provided electronically consisting of creating an individual account in the Store’s IT system.

Order – a declaration of intent made by the Buyer using the Order form in the Store, aimed directly at concluding a Sales Agreement for digital Products with the Seller.

Sales Agreement – an agreement for the sale of a Product concluded between the Seller and the Buyer.

  1. General Provisions
  1. These Terms and Conditions set out the rules for using the Store and the terms and conditions for ordering and purchasing Products.
  2. By placing an Order, the Buyer confirms that they have read and accepted these Terms and Conditions.
  3. The Seller provides services in accordance with these Terms and Conditions.
  4. Sales are governed by Polish law.

III. Payment Methods

  1. Prices displayed in the Store are stated in Polish currency and are gross prices, including applicable taxes.
  2. The Product price is binding at the time the Buyer places the Order.
  3. The Buyer may choose one of the following payment methods for Ordered Products:
    a) Electronic payment or payment by credit/debit card via the external payment service provider PayU.
    b) Traditional bank transfer to the Seller’s bank account:

  1. If the Buyer chooses a traditional bank transfer, the Order will be processed once the payment has been credited to the Seller’s account.
  1. Conclusion of the Sales Agreement
  1. The Sales Agreement is concluded when the Buyer places an Order and the Seller confirms acceptance of the Order (by e-mail).
  2. An Order is placed by completing the electronic Order form in the Store, including, in particular, providing the required personal and contact details.
  3. The Order includes:
    a) Acceptance of the Online Store Terms and Conditions.
    b) Where applicable, in the case of purchasing digital content (Online Course, File): the Buyer’s express consent to the delivery of the digital Product before the expiry of the 14-day withdrawal period and confirmation that the Buyer has been informed that they will lose their right of withdrawal once access is obtained (e.g. by downloading the File or logging in to the Online Course Platform).
  1. Order Fulfilment
  1. An Order for a Digital Product will be fulfilled immediately after the Seller receives full payment.
  2. Access to the Online Course or Electronic File will be provided to the Buyer by e-mail containing access instructions (an activation link and/or login credentials).
  3. Access to Digital Products is provided either for a limited period or indefinitely, in accordance with the description on the relevant Product sales page.
  1. Right of Withdrawal
  1. A Consumer has the right to withdraw from the Sales Agreement within 14 days without giving any reason.
  2. The withdrawal period begins on the date the Agreement is concluded.
  3. A withdrawal statement may be submitted using the form attached to these Terms and Conditions or sent to the Seller’s e-mail address.
  4. The Consumer does not have the right to withdraw from an agreement for the supply of digital content that is not supplied on a tangible medium if performance has begun with the Consumer’s express consent before the expiry of the withdrawal period and after the Consumer has been informed by the Seller that they will lose their right of withdrawal.
  5. In the case of Digital Products (Online Course, Electronic File), the Consumer loses the right of withdrawal when the Seller begins performance, i.e. when the Buyer is given access to the course content or the ability to download the Electronic File, provided that the Buyer has expressly consented to this.

VII. Complaints and Non-Conformity with the Agreement

  1. The Seller is liable for the Product’s non-conformity with the Agreement for a period of 2 years from the date of delivery of the Product.
  2. A complaint should be submitted in writing to the Seller at: ul. Żurawia 21, 05-503 Głosków, Poland, or electronically to: info@lecanonvarsovien.com
  3. The complaint should include: first and last name, address, e-mail address, telephone number, date of purchase, a detailed description of the defect/non-conformity, and the Buyer’s request (repair, replacement, price reduction, or withdrawal from the Agreement).
  4. The Seller will respond to the complaint within 14 days of receiving it.

VIII. Liability

  1. The Seller is not liable for damage resulting from the use of Products contrary to their intended purpose.
  2. The Seller is not liable for technical problems or limitations in the use of Products resulting from the Buyer’s failure to meet the technical requirements specified in these Terms and Conditions.
  3. The Seller’s statutory warranty liability (rękojmia) is excluded in relation to Entrepreneurs and Entrepreneurs with Consumer Rights.
  1. Personal Data
  1. The Seller is the Personal Data Controller of Buyers’ personal data.
  2. Personal data is processed for the purpose of performing the Sales Agreement and for marketing purposes, in accordance with the Privacy Policy.
  3. The Buyer has the right to access their personal data, rectify it, delete it, restrict its processing, the right to data portability, the right to object to processing, and the right to lodge a complaint with the supervisory authority.
  1. Newsletter
  1. The Newsletter service is free of charge.
  2. As part of the service, the Buyer receives commercial and marketing information from the Seller electronically.
  3. The Buyer may unsubscribe from the Newsletter at any time.
  1. Account
  1. Maintaining an Account in the Store is free of charge.
  2. The Buyer may place an Order without creating an Account, provided that the Store offers such an option.
  3. The Buyer has the right to delete their Account at any time.

XII. Amendments to the Terms and Conditions

  1. The Seller reserves the right to amend these Terms and Conditions for important reasons (e.g. changes in legislation).
  2. The Seller will inform Buyers of any amendments to the Terms and Conditions on the Store’s website and by e-mail (where the Buyer has an Account or Newsletter subscription).
  3. Amendments shall enter into force 14 days after their announcement. Orders placed before the amendments enter into force shall be governed by the previous version of the Terms and Conditions.

XIII. Complaints Procedure — Further Details

  1. In the case of a complaint concerning a Digital Product, after reviewing the complaint, the Seller may request information or cooperation from the Buyer that is necessary to determine whether the non-conformity with the Agreement results from the Buyer’s digital environment.
  2. Failure by the Buyer to cooperate may result in the claims not being upheld.

XIV. Consumer Protection

  1. Agreements concluded through the Store are distance contracts within the meaning of Polish law.
  2. Matters not regulated by these Terms and Conditions shall be governed by the provisions of the Polish Civil Code and the Act on Consumer Rights.
  1. Technical Requirements

To use the Store and purchased Products, in particular Online Courses (video materials), the Buyer must also have:

  1. A stable internet connection with a minimum download speed of 5 Mbps for smooth HD video playback.
  2. An internet browser (the latest stable version is recommended, e.g. Chrome, Firefox, Safari or Edge) with HTML5 and JavaScript enabled.
  3. A minimum recommended screen resolution of 1024 × 768 pixels for the correct display of the course platform interface.
  4. Software capable of reading files in PDF format and, depending on the specific Product, software capable of reading other file formats.

Important: The Buyer acknowledges that they are responsible for ensuring the compatibility of their digital environment (computer hardware, software and network connections) with the above technical requirements of the Platform.

XVI. Copyright and Proprietary Rights

  1. Digital Products, in particular Online Courses and Electronic Files, constitute works within the meaning of the Polish Act of 4 February 1994 on Copyright and Related Rights and are protected by law.
  2. The Buyer acquires only a licence to use the work for their own personal use.
  3. Without the Seller’s written consent, the Buyer may not, among other things, reproduce, distribute, make available, rent or lend the File or Online Course.
  4. In particular, the Buyer may not:
    • make available or transmit the content of the Online Course through live streaming or other media without the Seller’s written consent;
    • remove security features or markings placed on the File or Online Course;
    • reproduce or distribute the File or Online Course, whether in printed or electronic form;
    • make the File or Online Course available to other persons, whether in printed or electronic form;
    • rent or lend the File or Online Course, whether in printed or electronic form;
    • interfere with or modify the content of the File or Online Course.

XVII. Out-of-Court Dispute Resolution and Access to Such Procedures

  1. The Seller informs Buyers of the possibility of using out-of-court methods for handling complaints and pursuing claims.
  2. A Consumer has the right to refer a dispute to an entity authorised to conduct out-of-court consumer dispute resolution in accordance with the Act on Out-of-Court Consumer Dispute Resolution.
  3. The ODR (Online Dispute Resolution) platform is available at: http://ec.europa.eu/consumers/odr/.

XVIII. Final Provisions

  1. Matters not regulated by these Terms and Conditions shall be governed by the applicable provisions of Polish law.
  2. Buyers may access the Online Store Terms and Conditions free of charge at any time on the Store’s website and may print them.
  3. These Online Store Terms and Conditions enter into force on the date they are published on the Store’s website.

Within 14 days of concluding an agreement for the provision of services by electronic means with the Author (Registration), you may withdraw from the agreement without giving any reason.

IMPORTANT! Loss of the Right of Withdrawal

The User does not have the right to withdraw from an agreement concerning the purchase of an online Product or other digital content on the website pursuant to Article 38(12) of the Polish Consumer Rights Act of 30 May 2014 (Journal of Laws of 2014, item 827). Under this provision, the right to withdraw from an agreement concluded outside the business premises or at a distance does not apply to contracts for the supply of digital content that is not supplied on a tangible medium if performance has begun with the consumer’s express consent before the expiry of the withdrawal period and after the trader has informed the consumer that they will lose their right of withdrawal.
